ABOUT COOPS AND CONDOS

When purchasing a Cooperative apartment, the purchaser is actually purchasing personal property.  Ownership of the apartment building is held by the Cooperative Corporation.  In order to proceed to closing on the apartment, the purchaser usually will need to obtain approval form the Board of Directors of the Corporation.  At the closing,  the purchaser will receive a stock certificate in the Corporation indicating the purchaser's ownership interest, and a proprietary lease which will set forth the "rules of the road" for living in the Cooperative, including the right to sell, alterations, and subletting.

In contrast, a Condominium is treated as real property, and the Purchaser will receive a deed indicating the purchaser's ownerhsip interest.  Purchasers of a condominium unit usually require that the Condominium's board issue a waiver of its right of first refusal before proceeding to closing.  In addition, condominium purchasers will require title insurance, and if financing, will have to pay a mortgage recording tax.
